General Information

The protection of your personal data is very important to TMP-SYSTEM-SERVICE GmbH. We want to inform you which personal data is collected, how it is used and what options you have in this regard.

Where can I find the information that is important to me?

This general privacy notice provides an overview of the points that generally apply to the processing of your data by TMP-SYSTEM-SERVICE GmbH.

On what legal basis does TMP-SYSTEM-SERVICE GmbH process my data?

We process your data in accordance with European and German data protection laws. The provisions referred to below are provisions of the European General Data Protection Regulation, abbreviated GDPR. This means that we process data only to the extent and for as long as this is necessary to perform a contract with you or to carry out pre-contractual measures at your request (Art. 6 para. 1 b GDPR), or if you have given consent to the processing (Art. 6 para. 1 a GDPR), or if processing is necessary to safeguard legitimate interests pursued by us or third parties, for example in the following cases: asserting claims, defending legal disputes, detecting and eliminating misuse, preventing and investigating criminal offences, and ensuring secure IT operations at TMP-SYSTEM-SERVICE GmbH (Art. 6 para. 1 f GDPR). Processing may also take place due to legal requirements, for example retention of documents for commercial and tax purposes (Art. 6 para. 1 c GDPR), or in the public interest (Art. 6 para. 1 e GDPR).

What rights do I have?

You have the right to request information about categories of processed data, processing purposes, any recipients of the data and the planned storage period (Art. 15 GDPR); to request correction or completion of incorrect or incomplete data (Art. 16 GDPR); to withdraw consent at any time with effect for the future (Art. 7 para. 3 GDPR); to object, on grounds relating to your particular situation, to data processing that is based on legitimate interest (Art. 21 para. 1 GDPR); in certain cases under Art. 17 GDPR to request deletion of data, particularly if the data is no longer required for the intended purpose, is processed unlawfully, or if you have withdrawn consent or objected; under certain conditions to request restriction of processing where deletion is not possible or the deletion obligation is disputed (Art. 18 GDPR); and to data portability, meaning that you may receive data you have provided to us in a common machine-readable format such as CSV and, where applicable, transmit it to others (Art. 20 GDPR).

Does TMP-SYSTEM-SERVICE GmbH carry out credit checks and cooperate with credit agencies such as SCHUFA?

TMP-SYSTEM-SERVICE GmbH carries out a credit check before conclusion of a contract if it is to provide services that will only be paid for later. The purpose is to protect against payment defaults. To check your creditworthiness, we use data relating to your person and payment experience from existing contracts. This includes information such as name, address, date of birth, payment processing and sales figures. If existing data is insufficient for a check, we also obtain information from credit agencies and debt collection companies. For this purpose, we transmit your name, address, date of birth and IBAN to them. If we receive data from credit agencies or debt collection companies, we may also use scoring where required. This calculates the probability that a customer will meet payment obligations in accordance with the contract. The scoring is based on a recognised and proven mathematical-statistical procedure.

We store the result of the credit check for one year. The legal basis for this data processing is Article 6 para. 1 b GDPR.

We also transmit to SCHUFA Holding AG personal data collected in the context of the contractual relationship regarding the application for, performance and termination of the contract, as well as data concerning non-contractual or fraudulent behaviour. The legal bases for these transmissions are Article 6 para. 1 b and f GDPR.

SCHUFA processes the data received and also uses it for scoring purposes in order to provide its contractual partners in the European Economic Area and in Switzerland, and where applicable in other third countries for which an adequacy decision by the European Commission exists, with information including information for assessing the creditworthiness of natural persons. Independently of credit scoring, SCHUFA supports its contractual partners through profile creation to detect conspicuous circumstances, for example for fraud prevention in mail-order business. For this purpose, requests from SCHUFA contractual partners are analysed for potential anomalies. This calculation, which is carried out individually for the respective contractual partner, may also include address data, information on whether and in what function an entry relating to a person of public life with matching personal data exists in publicly accessible sources, and aggregated statistical information from the SCHUFA database. This procedure has no effect on creditworthiness assessment or credit scoring.

Will my data be used for advertising or market research purposes?

We use your personal data for advertising or market research where you have given consent; you may withdraw this consent at any time with effect for the future. We inform you of the possibility of withdrawal when obtaining consent. Different rules apply when you are online, for example when browsing our websites or using our apps. Information on this can be found in the privacy notices of the respective online offer.

To whom does TMP-SYSTEM-SERVICE GmbH disclose my data?

To so-called processors, meaning companies that we commission to process data within the legally permitted framework, Art. 28 GDPR (service providers, vicarious agents). TMP-SYSTEM-SERVICE GmbH remains responsible for protecting your data in such cases. We commission companies particularly in the following areas: IT, sales, marketing, finance, consulting, customer service, human resources, logistics and printing.

To cooperation partners who provide services for you or in connection with your TMP-SYSTEM-SERVICE GmbH contract under their own responsibility. This is the case if you order services from such partners through us, if you consent to the involvement of the partner, or if we involve the partner on the basis of a legal permission. In addition, TMP-SYSTEM-SERVICE GmbH aims to cooperate with other service providers, for example smart home services. If you are also a user of these services, you may link your respective account with them. This link must be made separately by you for each service. Once you have made a link, the personal data listed in these privacy notices from your respective account may be used for the corresponding service. The respective service provider will inform you about the processing of your personal data.

Due to legal obligations: In certain cases, we are legally obliged to transmit certain data to the requesting public authority. Example: After presentation of a court order, we are obliged under Section 101 of the German Copyright Act to provide rights holders with information about customers who are alleged to have offered copyrighted works on internet file-sharing platforms.

Where is my data processed?

Your data is processed only in Germany.

If your data is processed in countries outside the European Union, meaning in so-called third countries, this will only take place if you have expressly consented to it, if it is necessary for providing our services to you, or if it is provided for by law (Art. 49 GDPR). In addition, data is processed in third countries only if certain measures ensure an adequate level of data protection, for example an adequacy decision by the EU Commission or so-called appropriate safeguards pursuant to Art. 44 et seq. GDPR.
